Services Provided
Bamboo Wellness, LLC offers online and/or in-person nutrition coaching, fitness training, and educational content. Our services are intended for individuals seeking general wellness, fitness, and nutrition guidance. We do not provide medical diagnoses, prescriptions, or treatment for any medical condition.
Client Responsibilities; Health Disclosures
Client represents that they are in good health and have consulted with a physician regarding participation in exercise/nutrition changes, or has voluntarily elected to participate without such consultation. Client agrees to disclose to Bamboo Wellness, LLC any medical conditions, medications, injuries, or dietary restrictions relevant to the services. Client remains responsible for performing exercises safely, following instructions, and stopping any activity which causes pain or discomfort.
No Medical Advice; Results Not Guaranteed
The coach(es) at Bamboo Wellness, LLC are not a physician(s), a dietitian(s), or mental health provider and does not diagnose, treat, or prescribe. The services are educational and coaching in nature and are not a substitute for medical care. Outcomes and overall results depend on many factors. Bamboo Wellness, LLC coach(es) make no guarantees of weight loss, performance gains, biomarker changes, or other results.
Intellectual Property; Limited License
All materials, plans, and content provided by Bamboo Wellness, LLC (including training plans and meal plans) are the coach(es) intellectual property. Coach(es) can grant clients a personal, non-transferable license to use such materials solely for their own private, non-commercial use. Client will not copy, distribute, or share materials without the coach's written consent.
Assumption of Risk; Release
Client understands physical training and dietary changes involve inherent risks. To the fullest extent permitted by Nebraska law, client voluntarily assumes these risks and releases and holds harmless coach and coach's owners, employees, and contractors from all claims arising from ordinary negligence in providing the services. This release does not apply to gross negligence, willful misconduct, or violations of law.
Termination
Either party may terminate immediately for material breach if not cured within ten (10) days after written notice. Please see the Refund Policy regarding payments.
Independent Contractor
Coach is an independent contractor. Nothing herein creates an employer/employee, partnership, or joint venture relationship between coach and client.
Governing Law; Venue
Bamboo Wellness, LLC agreements are governed by the laws of the State of Nebraska without regard to conflicts rules. Exclusive venue and jurisdiction lie in the state courts located in Stanton County, Nebraska (or the U.S. District Court for the District of Nebraska, as applicable.)
Miscellaneous
Agreements represent the entire agreement of the parties. All amendments must be in writing and signed by coach and client to be binding. Agreements may not be assigned by client. Notices may be sent to info@bamboowellnessco.com and are deemed to have been received upon confirmation of delivery or the next business day.
Changes to these Terms & Conditions
Bamboo Wellness, LLC reserves the right to change, amend or alter these terms & conditions at anytime without prior notice. The updated version will be posted on our website with the revised "Effective Date". Continued use of our Services after such changes constitutes acceptance of the new Terms.
